Emirates Flight Delay Compensation: The £520 Claim Most Passengers Miss.

You’ve done the Dubai dream. The bag is packed, the playlist is ready, and you’re imagining a poolside drink within hours. Then the board flips to “Delayed.” Then it flips again. Four hours later you’re sat on the floor next to the only working plug socket, eating a £9 sandwich, wondering who owes you what.
Good news: there’s a decent chance Emirates owes you money. Bad news: airlines rarely hand it over without a nudge. I’ve gone through the UK rules so you don’t have to, and this guide covers who qualifies, how much you can claim, and what to do when Emirates says no.

Does Emirates compensate for delayed flights?
Yes, but only if the rules say so. In the UK, the rule is called UK261 (the post-Brexit version of the old EU rules). It covers flights departing from a UK airport on any airline, and that includes Emirates. It also covers flights arriving in the UK, but only when the airline is British or European.
Here’s the catch that trips people up. Emirates is a Dubai airline. So:
- UK → Dubai (or beyond) on Emirates: covered by UK261.

- Dubai → UK on Emirates: not covered by UK261, because Emirates isn’t a UK or EU airline. You’d need to rely on Emirates’ own policy or your travel insurance.
- UK → Dubai → Sydney on one booking: covered for the whole trip. What counts is how late you land at your final destination.
Handy tip: if your outbound flight left the UK, you’re usually in a good place. Check the official CAA guidance if you’re unsure.
How late does an Emirates flight have to be for compensation?
The magic number is three hours. And it’s measured when the plane arrives and the doors open, not when it leaves the gate. A flight that took off late but made up time in the air might not qualify. One that left on time but got stuck circling might.
Can I claim compensation for a 2 hour flight delay? Sadly no. Two hours falls short of the three-hour threshold. You’re still owed some basics though, which I’ll cover below.
What about an Emirates 5 hour flight delay? That’s a different story. Five hours clears the threshold easily, and on a long-haul route like UK to Dubai, you’re looking at the top rate. At five hours you can also choose not to travel and ask for a full refund.

What compensation am I entitled to if my flight is delayed?
The amount depends on the distance of your flight, not the price of your ticket. Per person, so a family of four multiplies it nicely.
| Flight distance | Example Emirates route | Compensation per person |
| Under 1,500 km | Rare on Emirates from the UK | £220 |
| 1,500 – 3,500 km | Not typical for Emirates | £350 |
| Over 3,500 km | London, Manchester, Birmingham, Glasgow, Edinburgh to Dubai (around 5,500 km) | £520* |

*If you land 3 to 4 hours late on a very long flight, the airline may cut it to £260. Four hours or more usually means the full £520.
Also worth knowing: you can claim for each passenger on the booking, children included. That’s £2,080 for a family of four on a long-haul flight. Not bad for sending a few emails.

Emirates flight delay: was it the airline’s fault?

This is where Emirates tends to dig in. Compensation is only due when the delay was within the airline’s control. If it was caused by “extraordinary circumstances”, they can say no.
| Usually the airline’s fault (you can claim) | Usually NOT the airline’s fault (they’ll refuse) |
| Technical or maintenance faults found during routine checks | Severe weather that makes flying unsafe |
| Crew shortages or late-arriving crew | Air traffic control strikes or airspace closures |
| Late arrival of the aircraft from a previous flight (generally) | Security threats or airport closures |
| Overbooking or operational scheduling problems | Hidden manufacturing defects affecting a whole fleet |
Emirates may blame “operational reasons” and leave it at that. That’s vague on purpose. Ask for the specific reason in writing. If they can’t show it was truly outside their control, your claim stands. That’s the heart of Emirates flight delay airline fault disputes.
How to make a claim against Emirates
You have two routes: do it yourself or use a claims company. Here’s the DIY version first.
- Gather your evidence. Booking reference, boarding passes, scheduled and actual arrival times, plus screenshots of any delay messages.
- Find the cause. Ask Emirates in writing why the flight was delayed.
- Write your complaint. Use Emirates’ online contact form or customer care channel. State the flight, the delay, the amount (£520 for most UK to Dubai flights) and cite UK261.
- Keep a paper trail. Save every email and reference number.
- Wait for the reply, then chase politely but firmly if it goes quiet.

How long do I have? Generally six years in England, Wales and Northern Ireland, and five in Scotland. So that flight from 2022 may still be claimable.
Or the lazy-but-smart route: hand it to a specialist. Services like CompensAir check your eligibility, send the claim and chase Emirates for you, and they only take a fee if you win. If you’re time-poor, that’s often worth it, because the back and forth can drag on for weeks.

What to do if Emirates rejects your compensation claim
Don’t panic. A first rejection is very common, and it’s often a template reply. Airlines know that plenty of people give up at this point. Don’t be one of them.
- Ask for the full reason and the evidence behind “extraordinary circumstances.”
- Reply in writing, point out UK261, and give them a deadline (14 days is reasonable).
- Don’t accept vouchers unless you’re happy with them. They’re worth less than cash and often come with conditions.
- Escalate. The CAA explains your options, including alternative dispute resolution (ADR) schemes and the court route. Use the CAA page on delays and cancellations for the latest steps.
- Go to court if needed. For claims under £10,000, the small claims track in England and Wales is the usual route, and a claims company can take this on for you.
I’ll be honest: the court route sounds scarier than it is, but it takes time. This is where a firm that does it every day earns its fee.
What you can claim for even if it’s under 3 hours
Short delay? You still have rights called “care and assistance.” They kick in based on how long the delay is and the flight distance (for Emirates long-haul, from about 4 hours).
- Meals and drinks in proportion to the wait
- Two phone calls, emails or messages
- A hotel and transfers if you’re stuck overnight
Keep your receipts. If Emirates doesn’t provide these, you can usually claim reasonable costs back.
Quick answers
| Question | Short answer |
| Does Emirates compensate for delayed flights? | Yes, if the flight left the UK and was 3+ hours late through the airline’s fault. |
| Can I claim for a 2-hour delay? | No compensation, but you may get meals and refreshments. |
| How much for a 5-hour delay? | Usually £520 each on UK to Dubai. |
| Time limit to claim? | Up to 6 years (5 in Scotland). |
| Emirates said no. Now what? | Ask for proof, escalate, or use a claims company. |
Final thoughts: don’t let Emirates keep your money
A delayed flight is annoying enough without feeling short-changed too. If you left a UK airport and landed three hours or more late, and it wasn’t down to weather or something similarly beyond Emirates’ control, you may be owed up to £520 each. The money is there. You just have to ask for it, which most people never do.
Take five minutes, find your booking details, and see where you stand.
